Terms of service

1. General provisions

The online store at shop.apisense.ai is operated by Apisense sp. z o.o., registered in Kraków, ul. Juliusza Osterwy 80, 30-699 Kraków, Poland, VAT PL6793247111, REGON 522960316, KRS [TO BE COMPLETED], e-mail: orders@apisense.ai, phone +48 606 153 759 (the „Seller").

These Terms set out the rules for concluding distance sales contracts, the rights and obligations of the parties, and the complaints procedure.

2. Definitions

  • Consumer – a natural person entering into a contract not directly related to their business or professional activity.
  • Sole trader treated as a consumer – a natural person entering into a contract directly related to their business activity where the contract is not of a professional character for them.
  • Goods – Apisense devices offered in the Store.

3. Technical requirements

Using the Store requires a device with internet access, a current browser and a valid e-mail address. Apisense devices additionally require a smartphone running iOS or Android and an active Apisense app subscription (section 9).

4. Placing an order

The customer places an order by adding Goods to the cart and confirming the purchase using the button marked as carrying an obligation to pay. The Seller confirms receipt of the order by e-mail. The sales contract is concluded at that moment.

5. Prices and payment

All prices shown include VAT. Prices do not include delivery costs, which are shown before the order is placed. Available payment methods are presented during checkout.

6. Fulfilment and delivery

Delivery terms are set out in the Shipping Policy. The Seller delivers within Poland and to European Union countries.

7. Right of withdrawal

A Consumer and a sole trader treated as a consumer may withdraw from the contract without giving a reason within 14 days of taking possession of the Goods. The procedure and model form are set out in the Refund Policy.

8. Complaints

The Seller is liable for any lack of conformity of the Goods with the contract under the Polish Consumer Rights Act. Complaints should be sent to orders@apisense.ai and are handled within 14 days of receipt.

9. Apisense app subscription

Apisense devices require an Apisense app subscription to function fully. The subscription is a service separate from the sale of Goods and is governed by separate terms. The app is provided free of charge until the end of the current year. Pricing applicable afterwards will be published in advance.

10. Personal data

The Seller is the controller of personal data. Processing is described in the Privacy Policy.

11. Out-of-court dispute resolution

Consumers may use out-of-court complaint and redress mechanisms, including the European Commission ODR platform at ec.europa.eu/consumers/odr, and the assistance of a district consumer ombudsman.

12. Final provisions

Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. Nothing in these Terms limits consumer rights arising from mandatory provisions of law.
